IriDefense does not guarantee that the Services will meet your requirements, that the Services will be available at all times, or that any particular features of the Services will be accessible. The VPN Service (coverage, speed, quality, and server location) may vary and may be unavailable for a variety of reasons, including but not limited to third-party service failure, emergencies, equipment, transmission or network limitations or problems, and interference or signal strength. IriDefense is not liable for any failure to maintain the accuracy, quality, security, or confidentiality of your data, messages, or pages, regardless of whether or not the failure is caused by service interruptions or performance issues.
IriDefense may, at its sole discretion, impose usage or service limits, suspend the Service, or block certain types of usage.
IriDefense shall not be liable, under contract, tort, strict liability, negligence, or any other legal theory, for any lost profits or indirect, special, incidental, punitive, or consequential damages of any kind arising out of the services. IriDefense and its partners, affiliates, subsidiaries, members, officers, and employees shall not be liable for any direct, indirect, special, consequential, or incidental damages, or any other loss or damages of any kind, even if advised of the possibility of such damages. This provision shall not apply where prohibited by law.
IriDefense is the owner of the IriDefense and its Service along with all respective visual interfaces, information, servers, products, software, graphical materials and all other elements of the service.
By using the Content and Service, you agree to indemnify, defend, and hold harmless IriDefense, its employees, members, directors, agents, suppliers, and affiliated companies and their employees, agents, directors, shareholders, and members, from any and all claims and expenses, including attorneys' fees, arising from your use of the Content and Service, including any violation of this Agreement. IriDefense may, at its sole discretion, assume the defense and control of any matter for which you are liable for indemnification. However, none of your indemnification obligations shall be excused.
